Terms of Service

These Terms of Service ("Terms") govern your use of the smartcon360.com platform and services (the "Service") operated by SmartCon360 ("we"). By using the Service you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

1. The Service

SmartCon360 is a cloud (SaaS) platform that unifies Location-Based Management (LBMS), Takt Time, Last Planner, Advanced Work Packaging (AWP) and Earned Value Management (EVM) for planning and managing construction projects in a single interface. We may improve, change or discontinue parts of the Service from time to time.

2. Accounts & responsibilities

• You are responsible for creating an account with accurate, current information and for keeping it updated.
• You are responsible for the confidentiality of your credentials and for all activity under your account.
• You must notify us promptly if you become aware of any unauthorized use.
• You must be of legal age and capacity to use the Service.

3. Acceptable use

When using the Service you agree not to:

• Violate applicable laws or the rights of third parties,
• Attempt to access, disrupt or overload the Service without authorization,
• Upload malware or attempt to bypass security measures,
• Upload data you do not have the right to, or process others' data without permission.

4. Your content & data

The project data and content you enter into the Service belong to you. You grant us the limited license necessary to host, process and display that content so we can provide the Service. You are responsible for the accuracy of your content and for holding the necessary rights. Details on how data is processed are in our Privacy Policy.

5. Intellectual property

The Service itself — its software, design, trademarks and content — belongs to SmartCon360 and is protected by intellectual property laws. These Terms grant you no ownership rights beyond the right to use the Service.

6. Fees & subscriptions

Some parts of the Service may involve paid plans or credit-based usage. Applicable fees, billing period and conditions are stated at the time of purchase. Unless stated otherwise, fees paid are non-refundable.

7. Third-party services

The Service may integrate with third-party services such as Google. Use of those services is subject to the respective provider's own terms and policies; SmartCon360 is not responsible for them.

8. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no express or implied warranties that the Service will be uninterrupted, error-free or fit for a particular purpose. Outputs and suggestions in the Service are decision support; final decisions remain the user's responsibility.

9. Limitation of liability

To the maximum extent permitted by law, SmartCon360 shall not be liable for any indirect, incidental, special or consequential damages, or loss of data or profits. In any case, our total liability is limited to the amount you paid for the Service in the twelve months preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your account if you breach these Terms. You may close your account at any time. Deletion of your data after termination is handled according to our Privacy Policy.

11. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye, and the courts and enforcement offices of the Republic of Türkiye shall have jurisdiction over any disputes.
